Our Terms and Conditions

The English version of our Terms and Conditions is a translated version of the original German text. The German version is the legally binding and authoritative version in the event of any discrepancies, ambiguities, or translation errors. Translation inaccuracies cannot be fully excluded. Here you will find important information about your purchase from Football Shirts Retail GmbH.

1. General provisions

On the online marketplace FootballShirts.com (“marketplace”), Football Shirts Retail GmbH (‘FBS’) and other businesses within the meaning of Section 14 of the German Civil Code (BGB) (hereinafter collectively referred to as “retailers”) offer goods for sale in their own name and on their own account. The respective responsible retailers are clearly identified on the respective item detail page. There you will also find all legally relevant information about the contractual partner of the respective purchase contract.

In addition, FBS offers a purchase service through which customers can sell clothing, sporting goods, and in particular football shirts at a pre-determined purchase price with little effort. In terms of the goods offered for sale, the marketplace is aimed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB). The purchase offer is aimed at private individuals and businesses, provided that they are not acting within the scope of a commercial series sale and retain all property rights to the goods offered.

Retailers based outside Germany or outside the European Union can also offer goods on the marketplace. Contracts with such dealers are subject to German law, insofar as this is legally permissible. The statutory consumer protection rights of the country in which the customer has their habitual residence remain unaffected. FBS merely provides the technical sales platform and, unless expressly stated otherwise, is not a party to the purchase contracts concluded between the dealer and the customer.

2. Conclusion of the contract

The presentation of the products on the marketplace does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking on the “Buy now” button, you are placing a binding order for the items in your shopping cart. After submitting your order, you will first receive an order confirmation, which merely documents the receipt of the order and does not yet constitute acceptance of the offer.

Depending on the selected payment method, the purchase contract is concluded as follows:

· Instant payment methods (e.g., PayPal, instant bank transfer, credit card):

Upon successful authorization of the payment or successful completion of the payment process.

· Other payment methods:

By express order confirmation via email or by delivery of the goods within the specified delivery time.

The contractual partner is the retailer listed on the item detail page, unless it is expressly stated that FBS itself is the seller of the goods.

3. Right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Football Shirts Retail GmbH, Cuxhavener Str. 7, 28217 Bremen, Germany, email: support@footballshirts.com) of your decision to withdraw from this contract by means of a clear statement (e.g. by email or post). You can use the attached sample withdrawal form for this purpose; however, its use is not mandatory.

The declaration of withdrawal must be made to the respective contractual partner. For items sold directly by other retailers on the marketplace, the withdrawal must therefore be declared to the correspondingly designated retailer; FBS forwards notices of withdrawal that are mistakenly sent to FBS to the responsible retailer as a non-binding customer service, without thereby assuming the status of a contractual partner.

To comply with the withdrawal period, it is sufficient to send the notification of the exercise of the right of withdrawal before the expiry of the period.

Consequences of revocation

In the event of an effective revocation, the respective retailer must reimburse you for all payments it has received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by the retailer), without delay and at the latest within 14 days from the day on which the retailer received notification of your withdrawal.

The same means of payment used by you for the original transaction will be used for the refund, unless expressly agreed otherwise; in no event will you be charged for this refund. The merchant may refuse to refund until he has received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods to the merchant or hand them over to the merchant's authorized transport service provider immediately and at the latest within 14 days of the day on which you informed the merchant of the cancellation. The customer bears the direct costs of returning the goods, unless otherwise agreed or required by law.

For items purchased via the marketplace from third-party providers, FBS can provide organizational support for the return. In such cases, the return is made exclusively on behalf of the respective merchant, without FBS assuming any contractual obligations or a seller position.

You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties, and functionality.

4. Exclusion and expiry of the right of withdrawal

According to § 312g (2) BGB (German Civil Code), the right of withdrawal does not apply to the following contracts, among others:

  • Delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer (e.g., personalized or individually flocked jerseys).
  • Delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.
  • Delivery of audio or video recordings or computer software in sealed packaging, if the seal has been removed after delivery, provided that such products are offered.

The right of withdrawal expires prematurely if the customer expressly agrees that the execution of the contract will begin before the expiry of the withdrawal period and confirms their knowledge that they may lose their right of withdrawal upon complete fulfillment of the contract, provided that this is required by law (e.g., for digital content without a physical medium).

Supplementary provisions on returns and refunds can be found in our Refund Policy in its currently valid version at: https://www.footballshirts.com/policies/refund-policy. These provisions are considered part of these General Terms and Conditions, provided they do not conflict with statutory consumer rights or the provisions of these General Terms and Conditions.

5. Delivery

Items are delivered exclusively in normal household quantities and only to consumers within the meaning of § 13 BGB (German Civil Code).

Orders from different retailers may be delivered in partial deliveries for logistical reasons. This does not result in any additional costs for the customer, unless expressly agreed otherwise.

6. Warranty

The statutory warranty rights apply.

If delivered items have obvious material or manufacturing defects (including transport damage), the customer is requested to report these to the retailer or the responsible transport company immediately.

Failure to do so has no influence on the customer's statutory warranty claims.

An additional warranty only exists if this is expressly stated for the respective item. A general warranty is not provided.

7. Shipping and service costs

For orders over EUR 100.00 (including VAT), delivery within Germany is free of charge. Below this order value, EUR 4.90 (including VAT) will be charged per order. For deliveries outside Germany, the shipping conditions available at https://footballshirts.com/policies/shipping-policy apply. The provisions listed there are part of these General Terms and Conditions, unless they contradict mandatory legal requirements.

8. Payment

Payment can be made using the payment methods listed on the website, currently including:

PayPal, credit card (Mastercard/VISA), Klarna, Apple Pay, Google Pay.

There is no entitlement to use a specific payment method. The merchant reserves the right to offer only selected payment methods in order to minimize risk or due to technical requirements.

The marketplace uses the payment service provider Shopify Payments, Shopify Inc., 151 O'Connor Street, Ground Floor, Ottawa, ON, K2P 2L8, Canada, to process payments. Payment data is processed on the basis of Art. 6 (1) lit. b GDPR (contract fulfillment). For more information, please see our privacy policy.

A cash discount is excluded.

Payment via PayPal

You pay via your PayPal account. After completing the order process, you will be redirected to PayPal. The charge will be made upon authorization or shipment, depending on the type of item. For custom-made or personalized goods, the charge will be made immediately after authorization.

Payment by credit card

Your credit card will be charged upon shipment, or immediately upon authorization for personalized/custom-made items.

Payment via Klarna

For payments with Klarna, the terms of use of Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden, apply in addition.

GDPR notice: Klarna processes personal data under its own responsibility. The payment method “Klarna Express Checkout” requires a Klarna account.

Apple Pay & Google Pay

With Apple Pay/Google Pay, authorization is carried out via your respective user account. Depending on the settings, the charge is made upon authorization or shipment, and for personalized items immediately after authorization.

9. Repayment/refunds

Refunds are generally made using the same payment method that the customer used for the original transaction, unless otherwise agreed.

The refund of the purchase price or any overpayments is primarily made by the respective merchant who is the customer's contractual partner. FBS can take over the technical processing of the refund on behalf of the merchant without itself becoming a contractual partner in the purchase agreement.

If the merchant does not fulfill its repayment obligation within a reasonable period of time or if the technical processing of the repayment via the original payment method is no longer possible (e.g., account closed, card expired), FBS may carry out the repayment by way of voluntary assumption of performance. In such cases, FBS acts exclusively as a service provider, without this resulting in a change of debtor or an assumption of debt in the legal sense.

The customer's legal claims against the respective merchant remain unaffected by this.

10. Prices

All prices are quoted in euros (EUR) and include the applicable statutory sales tax. For deliveries outside the EU, additional customs or import fees may apply, which are to be borne by the customer.

11. Retention of title

Until full payment of the purchase price, the delivered goods remain the property of the respective selling merchant. FBS is only the owner if FBS itself is the seller of the respective goods.

12. Purchase of your products by us (purchases)

I. Conclusion of the contract and further procedure

You submit an offer to us to purchase products by using one of the corresponding purchase functions on our website at www.footballshirts.com, via our official social media channels, or via WhatsApp (classic purchase or purchase as part of a trade-in, i.e., simultaneous sale and new purchase). To do this, you inform us of the product you are offering and describe its condition (we usually provide a list of criteria for this purpose). We only purchase products that meet our specifications in terms of type, condition, and quality. You then have the opportunity to check your details and correct them if necessary before submitting a binding offer to sell to us.

You can revoke your offer to sell by canceling the order until the product is shipped or until a (partial) payment is initiated. Once the product has been accepted by the shipping service provider, it is no longer possible to revoke the offer to sell. We are also entitled to cancel a sales order you have created at any time until it is handed over to the shipping service provider without giving reasons.

You have 14 days from the date of submission of your offer to sell to send us the product offered. Upon receipt, we will check the condition of the goods immediately. We expressly point out that shipments may be rejected in their entirety, regardless of the condition of individual products, if it is unreasonable for us to inspect the contents of the shipment for health or hygiene reasons. Unreasonableness is particularly evident if the shipping packaging or the contents are heavily soiled or if an odor suggests moisture or mold growth. In such cases, you may be charged for any additional costs incurred.

If the product, including its condition, matches your description, we will accept your offer by email at the price already determined; the contract is then concluded. This also applies if you use our service via cooperation partners.

If the actual condition of the goods differs from your description, we will reject your offer to sell and send you a new purchase offer by email with a price adjusted to the condition determined (counteroffer). You can accept or reject this counteroffer within 14 days of receipt. If you accept the counteroffer, the contract is concluded on this basis. If you reject it, no contract will be concluded; we will return the product to the address you provided, free of shipping costs and at our risk, after giving you prior notice.

If you do not respond to a counteroffer within 14 days, i.e., neither expressly accepting nor rejecting it, we will assume that you wish to accept the counteroffer. In this case, a corresponding contract will be concluded on the basis of the counteroffer. We will expressly point out this legal consequence in the counteroffer.

If it turns out that we cannot purchase the items sent in (e.g., goods not carried in our range, defective or non-original products), we will reject your offer to sell and offer you free return shipping at our risk. Alternatively, you can declare that the product should become our property without compensation.

If you offer several products, a separate purchase contract is concluded for each individual product (in the case of identical products, only under the conditions specified below). Purchases are only made in quantities customary for consumers. If you offer the same product multiple times or in unusually large quantities, we reserve the right to make acceptance of your offer dependent on the presentation of suitable proof of ownership. The same applies to an unusually high number of offers or sales orders. In these cases, you may be classified as a commercial supplier. Our customer service team will contact you in this regard.

If you send additional products not listed in the offer in the same package, we will assume, based on the shipment you have initiated, that these items are also part of your offer at the estimated price stated on our website or in our communications and are to be sold to us without additional compensation, unless there are obvious circumstances to the contrary or you provide a corresponding clarification within 10 business days of handing over the package to the shipping service provider. Contrary circumstances exist in particular if items that were clearly not intended to be included have been enclosed (e.g., identification documents, money, securities); in such cases, we will contact you.

Upon acceptance of your offer, we acquire ownership of all products in the shipment for which no separate offer has been made and which, according to the above criteria, are attributable to your intention to sell. If we offer you a new price due to a different condition, this also applies to the entire contents of the shipment, unless there are different individual offers or the items were included unintentionally. We reserve the right to return items that are not offered to you and to charge you for the resulting return costs.

If a product sent in cannot be assigned to a customer or order, we will store it for three months from receipt. If no assignment or feedback is received within this period, ownership of the product will be transferred to Football Shirts Retail GmbH; the product will then be recycled or disposed of. We may request proof of ownership for assignment purposes.

During the inspection of the goods, minor changes may be made to the item, in particular by opening sealed packaging, affixing a removable sticker (object ID), removing dirt, or affixing security labels. This inspection takes place before your offer is accepted or a counteroffer is sent. If you reject the counteroffer, you will receive the item back in this altered condition.

If indicated in the purchase process, we offer express processing for certain items. This can be requested as an option; there is no entitlement to it. Feasibility depends in particular on the condition of the shipment, its conformity with the sales order, and logistical factors. If express processing is not completed within one business day despite a request, processing will follow the regular process. If your offer is accepted, you will receive the specified price plus the fee for express processing.

II. Shipment for purchase; shipping costs & transport risk

The seller bears the costs of shipping. For shipments from Germany and Austria, a prepaid shipping label can be requested from FBS; the cost of this will be deducted from the payment amount. All products must be carefully packaged and insured for shipping. In case of non-compliance, the seller bears the risk of damage or loss, especially in the case of private shipping. FBS may request proof of ownership or proof of purchase. If ownership cannot be proven, the sender also bears the risk of loss or damage during transport.

III. Payouts

Payment will be made after acceptance of the offer, counteroffer, or new offer via your chosen payment method (bank transfer, PayPal, or FBS voucher). In the case of payment by bank transfer or PayPal, the seller bears the risk of incorrect information. Payments are usually made within 2 to 7 business days. Additional costs may apply for international transfers. If you choose a voucher, you will receive a voucher code by email; the voucher value corresponds to the purchase price plus a 10% surcharge. Cash payment of the voucher value is excluded; the voucher terms and conditions apply. If express processing is requested but not feasible, the stated price plus express fee will be paid out.

IV. Ownership and warranties regarding the products; indemnification

By submitting your offer, you warrant that you are the lawful owner of the product offered and are entitled to sell it and transfer ownership. The goods offered are free from third-party rights. You indemnify us against all third-party claims resulting from a breach of these representations, as well as against all resulting damages and costs (including necessary or reasonable legal or court measures).

13. FBS gift vouchers: General voucher terms and conditions

You have the option of purchasing virtual gift vouchers with a monetary value of 10, 20, 50, 75, 100, 250, or 500 euros for our online shop.

After completing the voucher purchase, you will receive an email with your personal voucher code to the email address stored in your customer account. You can redeem this code yourself or pass it on and give it as a gift. To redeem the voucher, you can shop as usual in the FBS online shop and add products to your shopping cart. After selecting your payment method, enter your voucher code in the field provided. The voucher value will be credited to your voucher account and deducted from the total amount payable during the payment process.

If the invoice amount exceeds the value of your gift voucher, you can only pay the difference with PayPal or credit card. If the invoice amount is less than the voucher value, the remaining value will remain as credit in your voucher account. The amount available there will be automatically credited to your next order.

Gift vouchers can be applied to all products offered directly by FBS.

Products purchased with a gift voucher can be returned in accordance with our applicable guidelines. In the event of a return, the purchase price will be refunded in the form of a credit to your voucher account. If you used another payment method in addition to the gift voucher when placing your order, the refund will be made primarily and up to the amount of the voucher portion by crediting your voucher account. If the amount to be refunded exceeds the portion paid with the voucher, the difference will be refunded via the other payment method used when placing the order.

FBS accepts no liability if payment with a gift voucher is temporarily unavailable due to technical problems. In this case, please contact our customer service.

FBS gift vouchers can only be redeemed in the currency in which they were purchased. Conversion into other currencies is not possible.

FBS gift vouchers are valid for three years from the date of purchase.

You have the right to withdraw from the purchase contract for a gift voucher within 21 days of concluding the contract. Withdrawal is subject to the statutory provisions.

14. Alternative dispute resolution

The retailer is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Contract language / Storage of the order text

The contract is concluded in German or in the language of the respective product page. The order text is not stored by FBS or the merchant and cannot be retrieved after the order process has been completed. However, you can print out your order data immediately after submitting the order.
